  5. SHAREWARE LICENSE TERMS
  6.  
  7. The Winston Installer utility is NOT public domain or free software,
  8. but is being distributed as SHAREWARE.  This means that if
  9. you are a regular user of Winston Installer you should register and
  10. recieve the enhanced version as a bonus.  Only from the
  11. income from your registrations can the authors continue to
  12. provide product support, make enhancements and basically
  13. stay in business.
  14.  
  15. Non-registered users of this software are granted a limited
  16. license to make an evaluation copy for the trial use on a
  17. private, non-commercial basis, for the purpose of determining
  18. if Winston Installer is suitable.  At the end of this trial period,
  19. the user should either register his or her copy or discontinue
  20. use.
  21.  
  22. Registered users of Winston Installer may use Winston Installer on any computer
  23. as long as there is no chance of the same copy being run on
  24. multiple computers at the same time.
  25.  
  26. Operators of BBS'S are encouraged to post Winston Installer and other
  27. material by DSI, for downloading by their users.
  28.  
  29. This license to use Winston Installer does NOT include the right to
  30. distribute or sell Winston Installer.  These terms follow.

  33. DISTRIBUTION OF Winston Installer BY VENDORS AND COMPUTER DEALERS
  34.  
  35. Distributers of "public domain" or user supported software
  36. libraries must obtain written permission to distribute
  37. Winston Installer and related material.  No one may use Winston Installer
  38. as a promotion for any commercial venture or as an enticement
  39. for the user to pay for any program, product, or service
  40. unless they have RECEIVED the express written permission of
  41. the programs author.
  42.  
  43. In order to distribute Winston Installer the dealer must comply with
  44. the following conditions:
  45.  
  46.     1.)  You must obtain written permission from DSI
  47.          to distribute Winston Installer.  If you receive no reply,
  48.          write again: or silence does not constitute
  49.          permission, and you may not distribute pending
  50.          receipt of permission.
  51.  
  52.     2.)  A fee no greater than $10.00 may be charged for each
  53.          disk sold.  Winston Installer may not be included on any
  54.          disk sold for more than $10.00, including CD-ROM or
  55.          optical disks, w/o express written permission from
  56.          DSI.
  57.  
  58.     3.)  Vendors may not modify or delete any files on the disk.
  59.          Vendors may add a "GO" or any other reasonable text
  60.          file to assist the user.  These files added by the
  61.          vendor must be easily identifiable and end users must
  62.          be allowed to delete the added files.
  63.  
  64.     4.)  Vendors must make a reasonable effort to distribute
  65.          only the most recent versions of Winston Installer.  All
  66.          vendors who have requested and receeved written
  67.          permission to distribute Winston Installer will be notified
  68.          of updates as they are released.

  71. DSI disclaims all warranties relating to this
  72. software, whether expressed or implied, including but not
  73. limited to any implied warranties of merchantability and fitness
  74. for a particular purpose, and all such warranties are expressly
  75. and specifically disclaimed. Neither DSI nor
  76. anyone else who has been involved in the creation, production or
  77. delivery of this software shall be liable for any indirect,
  78. consequential or incidental damages arising out of the use or
  79. inability to use such software even if DSI has
  80. been advised of the possibility if such damages or claims. In no
  81. event shall DSI liability for any damages ever
  82. excedd the price paid for the license to use the software,
  83. regardless of the form of claim.  The person using the software
  84. bears all risk as to the quality and performance of the
  85. software.

  87. Some states do not allow the exclusion of the limit of liability
  88. for consequential or incidental damages, so the above
  89. limitation may not apply to you.

  91. This agreement shall be governed by the laws of the State of
  92. California and shall inure to the benefit of DSI
  93. and any successors, administrators, heirs and assigns.  Any
  94. action or proceeding brought by either party against the
  95. other arising out of or related to this agreement shall be
  96. brought only in a STATE or FEDERAL COURT of competent jurisdiction
  97. located in Benicia, California.  The parites herby consent to in
  98. personam jurisdiction of said courts.

  100. This software and the disks on which it is contained is licensed
  101. to you, for your own use.  This is copyrighted software.  You
  102. are not obtaining title to the software or any copyright rights.
  103. You may not sublicense, rent, license, convey, modify, translate,
  104. convert to another programming language, decompile or
  105. disassemble the software for any purpose.
  106.  
  107. You may make as many copies of this software as you need for
  108. back-up purposes.  You may not use this software on more than one
  109. computer, provided there is no chance it will be used
  110. simultaneously on more than one computer.  If you need to use
  111. the software on more than one computer simultaneously, please
  112. contact me for information about site licenses.

  117. If you believe your copy of Winston Installer has been tampered or
  118. altered in anyway, shape or form.  Please contact us
  119. immediately!  We'll get you an unadulterated copy
  120. immediately, by the mail or via modem. Do not hesitate a
  121. moment to inform us.  Remember, shareware should be
  122. available to all, in the original form, so please do not
  123. accept modified or damaged versions of our software.

  149. enclose a self-addressed, stamped envelope (SASE) with sufficient
  150. postage.  If you don't enclose a SASE, your material will not be
  151. returned.

  156.       1.)  The version of Winston Installer.  The version number is
  157.            displayed on the main window and in the output file.

  160.            Megatrend 286, VGA, hard drive etc.

  162.       3.)  A copy of your Autoexec.bat, config.sys, win.ini and system.ini.

  164.       4.)  Any TSR's that you are running.

  283. The program(s) marked to Run is/are started like this:
  284. FileN ! <- notice the "!" parameter; this is so that you can have your
  285.        program do special init type things and then exit (like
  286.        writing a new INI file).

  288. When WINSTON INSTALLER is started it presents the user with an option of installing
  289. your program into Windows' directory or any specified directory.  If the 
  290. directory is not found, it will be created.

  293. Naming of the program
  294. ---------------------------------
  295. You are free to change the name of Winston Installer to best suit your needs.  The
  296. INI file must be named the same as the install program.
  297.  
  298. If you decide to call it "MYINST.EXE" then the INI must be "MYINST.INI"
